Acceptable Uses Policy

Legal compliance

You must use the Services in accordance with, and only as permitted by, applicable law. The use of our services in connection with other tools or resources that promote any form of unacceptable use as described here is also not permitted. In the event of a breach of these guidelines for acceptable use, the Supplier may, at its own discretion, do one or more of the following:

  • suspend (temporarily or permanently) or terminate your use of the Services;
  • block your access to the Services,
  • remove or delete content from your account(s), or
  • communicate such breach to affected third parties and/or law enforcement authorities (where applicable and subject to applicable law).

Your responsibility

You are responsible for your content, customer data, behavior and communication with others when you use the services. You must comply with the following requirements when using the Services. If we are made aware of content or customer data that falls outside the boundaries set out in these guidelines, we may remove and report it. We also take measures to prevent the use of our services that is contrary to the purpose of these guidelines.

a) You may not use the services to perform an illegal act, use the services for activities where use or non-use of the service may lead to physical harm, death, mental harm or personal injury.

b) You may not provide access to the Services to any person under the age of 13 (or under a higher age as determined in some countries or territories).

c) You may not purchase, use or access the Services to create a competing product or service or for any other competitive purpose.

d) You may not abuse our services by interfering with normal operation, or attempt to use them by any method other than through the interfaces and instructions we provide.

e) You may not circumvent or attempt to circumvent any restrictions that the Provider has placed on your use of our services or your account(s) (such as by opening a new account to create or distribute a survey, form, application or questionnaire that we have closed following a breach of our terms and guidelines).

f) Unless the Supplier has given written permission to do so, you may not probe, scan or test the vulnerability or security of the Services or any Supplier system or network.

g) Unless the Provider has given written permission to do so, you may not use any automated systems or software to extract or scrape data from websites or other interfaces through which we make our services available.

h) You may not deny others access to, or reverse engineer the Services, or assist anyone else to do so, to the extent such restrictions are permitted by law.

i) You may not store or transmit viruses, malware or other types of harmful software, or links to such software, through the Services.

j) You may not use the Services to infringe the intellectual property rights of others.

k) Unless the Supplier has given written permission to do so, you may not resell or rent out the services.

l) If your use of the services requires you to comply with industry-specific regulations that apply to such use, you will be solely responsible for such compliance, unless the Supplier has agreed otherwise with you in writing. You may not use the services in a way that subjects the Supplier to the industry-specific regulations, without obtaining written permission from the Supplier in advance. For example, you may not use the Services to obtain, protect or otherwise handle "protected health information" without entering into a separate business relationship agreement with the Provider that allows you to do so.

m) We may offer content such as images or video provided by third parties. You may only use this material in content and customer data. The Supplier may change or withdraw the permission at any time at its sole discretion. When using such material, you may not give the impression that your content, customer data or use of the services is associated with or recommended by any company, product, brand or service displayed in the material, unless you have obtained their permission.

n) You may not engage in illegal or excessive use of the Services, which is use that significantly exceeds the average usage patterns of reasonable users similar to you, including use that affects the speed, response time, stability, availability or functionality of the Services for other users . The Provider will endeavor to notify you of illegal or excessive use to provide you with the opportunity to reduce such use to a level acceptable to the Provider, which no longer causes such undesirable effects.

o) You must use a valid email address to register an account. You may not register accounts with a temporary or disposable email address, "bots" or other unauthorized automated methods.

p) You may not store or transmit content that is or contains false, inaccurate or deliberately misleading information likely to cause harm to the public or adversely affect the public interest (including health, safety, electoral integrity and civic participation).

q) If the Provider determines in its sole discretion that your use of the Services causes damage to our brand or reputation, or leads to an excessive number of complaints, the Provider has the right to suspend or terminate your use of our websites and services.

Phishing and security

We work to protect the security of all our users. We take concrete measures to ensure that respondents are not misled by surveys/forms/applications/questionnaires that are used for fraud or malicious purposes. We will suspend all use of the Services or remove any content or customer data that is brought to our attention, such as:

  • attempt to obtain, in our sole discretion, social security numbers or similar government-issued identification numbers, credit card numbers (except solely for the purpose of obtaining payment through an approved payment provider as permitted by the Services), passwords or other similar types of sensitive information;
  • publishes an individual's identifying information without their consent;
  • is intended to deceive or mislead respondents, including by linking to websites with malicious software such as malware,
  • promotes or recruits for pyramid schemes, multilevel marketing campaigns, or "work from home" and other similar fake income scams,
  • knowingly and artificially increases or enhances the search engine ranking or reputation of one or more websites, including by offering or selling "likes", followers, reviews, comments or similar services, or
  • hosts content that is downloadable, streamed in real time, or simply intended to generate clicks to other sites.

Privacy and impersonation

Users provide answers and information with the expectation that the information will be handled with respect and will not be misused. Accordingly, you are responsible for complying with all applicable data protection laws and regulations with respect to data you submit or collect through our Services.

  • We encourage you to disclose your privacy practices when you use the Services and, if you do, we require you to act in accordance with those practices.
  • You cannot claim that surveys/forms/program/questionnaires or other use of the services are anonymous when this is not the case.
  • You may not pretend to be someone else when using the Services or obtaining information.

Requirements for e-mail and text messages

The provider has zero tolerance for spam. This means the following:

  • Emails or text messages you send through the Services must contain a valid survey/form/application/questionnaire for the purpose of soliciting responses (with the exception of certain automated messages such as "thank you" emails, where applicable).
  • Emails you send through the Services must have a valid reply-to email address owned or managed by you. You cannot use a "no-reply" address as the sender email address.
  • Text messages you send through the Services must include your company name.
  • You may only use the Services to send emails and text messages to persons who have consented, or otherwise validly consented, to receive communications from you, the sender, through the appropriate medium. If you do not have documentation that each recipient has consented to emails or text messages (as applicable), you must not import them into any list in the Services. We do not allow the use of harvested email lists.
  • We do not allow the use of third-party, purchased or rented email lists unless you can demonstrate that the people on the list have agreed to receive emails of the type you want to send them.
  • You must not send unsolicited e-mails to newsgroups, message boards, distribution lists or e-mail addresses.
  • You must not use the Services to send any emails or text messages in a manner that is not permitted under or in accordance with applicable law, provider compliance requirements or industry standards, or to any recipient who has opted out, unsubscribed or otherwise manner refused to receive such messages from you or any party on whose behalf you are acting.
  • You must not use the Services to send emails with misleading subject lines or false or misleading header information.
  • Email messages sent in connection with our Services must contain an "unsubscribe" link that allows subscribers to remove themselves from your email messages. You acknowledge and agree that you will not hide, disable or remove, or attempt to hide, disable or remove, the unsubscribe link from the email invitation. You will actively manage and process unsubscribe requests received by you directly within ten days of submission and update mailing lists and address books to reflect unsubscribe requests.
  • You are responsible for ensuring that the emails you send in connection with your surveys/forms/applications/questionnaires, or any use of our services, do not generate a number of spam complaints or returns that exceed industry standards. If the Provider determines that the rate of spam complaints or returns exceeds industry standards, the Provider has the right, in its sole discretion, to suspend or terminate your use of our services and websites. If you experience low response rates, high abuse or high returns, or we receive complaints related to your use of our Services, we may request additional information about your mailing lists to investigate and attempt to resolve the issue, or in some cases we may suspend or remove your email privileges.
  • Text message invitations that you send through our Services must have a valid "Stop" response.
  • You may not use the Provider's text messaging services to obtain or provide access to emergency services.
  • If we believe that you violate any of these prohibitions, we may suspend (temporarily or permanently) or terminate your account(s).

Violence and hate speech

We remove content or customer data and may report information related to the content or customer data to law enforcement authorities if we become aware of, or believe that, there exists a genuine danger or threat to public safety.

  • Our services cannot be used to directly or indirectly threaten or attack others, or to organize or incite violence, harassment, terrorism or material damage.
  • Our services cannot be used for hate speech, or to promote or finance such actions. Examples of hate speech include attacking or inciting abuse or exclusion of people based on their ethnicity, national origin, political or religious affiliation, gender, age, sexual identity, genetic predisposition, disability, medical or physical condition, veteran status, or any other protected classes under current legislation.
  • Our services cannot be used to encourage, promote or glorify self-harm or acts of terrorism.

Bullying, harassment and criminal activity

You may not use our Services to bully or harass others, to promote criminal activity, or in violation of any applicable law.

Pornography and offensive graphic material

We recognize that nudity, pornography and graphic violence have a legitimate place in certain types of use of our services. However, we advise against including such content in an unmotivated manner.

  • You may not include violent graphic material or pornography in an unjustified manner in connection with the use of our services.
  • We recommend including a screenshot with a clear warning before material that can be perceived as offensive is shown.
  • Showing sexual or pornographic content (including in cartoon form) involving minors is strictly prohibited, and we report such content to law enforcement authorities.

Infringement of intellectual property

Respect the intellectual property rights of others. You must have the necessary rights to use any content or customer data. It is your responsibility to determine what rights you need, to obtain and maintain those rights, and to understand how you are permitted to exercise those rights. You may include content, including logos, brands and other indicia of third parties, (a) to the extent permitted as fair use or otherwise under applicable law, and (b) as long as the use does not (i) create confusion as to its origin to or the sponsorship of a product or service, (ii) implies sponsorship or endorsement by the trademark owner where none exists, or (iii) inaccurately describes a product or service.

How to report policy violations

If you suspect that someone's use of our Services violates these policies, please contact us immediately at legal@retailx.no, and we will investigate. Attach the URL address of the survey/form/application/questionnaire or other relevant content.
